These Terms of Service ("Terms") constitute a legally binding agreement between you or the organisation you represent ("Client") and TweakSpace Group Limited, a company incorporated in Kenya.
By clicking "Agree", signing up for an account, or using any of our services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
If you are accepting on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.
TweakSpace provides a cloud-based customer experience platform including, but not limited to:
The specific services available to you depend on the subscription plan you have selected. We reserve the right to modify, update, or discontinue any feature with reasonable notice.
To access the platform, you must register for an account by providing accurate and complete information. You are responsible for:
You must be at least 18 years old to create an account. We reserve the right to refuse registration or suspend accounts at our discretion.
Subscription fees are as published on our Pricing page or as agreed in a separate order form. All prices are quoted in Kenyan Shillings (KES) and exclude applicable taxes.
Subscriptions are billed monthly in advance. Payment is due within 7 days of invoice. Accepted payment methods include M-Pesa, bank transfer, and credit/debit card.
Accounts with overdue balances beyond 14 days may have service access restricted until payment is received. Balances overdue by 30 days may result in account suspension.
Subscription fees are non-refundable except where required by Kenyan consumer protection law or as explicitly agreed in writing. The 14-day free trial period allows you to evaluate the platform before any charges apply.
You agree not to use TweakSpace's platform to:
Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account without refund.
TweakSpace IP: All software, designs, trademarks, and content comprising the TweakSpace platform are owned by or licensed to TweakSpace Group Limited. These Terms do not grant you any ownership rights — only a limited, non-exclusive licence to use the platform for your internal business purposes.
Your content: You retain full ownership of all data, content, and materials you upload to the platform. By using our services, you grant TweakSpace a limited licence to process your content solely to deliver the services described in these Terms.
Feedback: Any feedback, suggestions, or ideas you provide about our services may be used by TweakSpace without restriction or compensation to you.
Your use of TweakSpace is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
For enterprise clients requiring a Data Processing Agreement (DPA) in line with the Kenya Data Protection Act, 2019, please contact info@tweakspace.com.
We target 99.8% platform uptime, excluding scheduled maintenance windows communicated in advance. For full details of service level commitments, response times, and support channels, please refer to our SLA & Support Policy.
Scheduled maintenance will typically be performed outside peak business hours (Mon–Fri, 8 AM–6 PM EAT) and communicated at least 48 hours in advance where possible.
To the maximum extent permitted by Kenyan law, TweakSpace shall not be liable for:
Our total cumulative liability to you in any 12-month period shall not exceed the total fees paid by you to TweakSpace during that period.
Nothing in these Terms limits liability for death, personal injury, or fraud caused by TweakSpace's negligence.
By you: You may cancel your subscription at any time by providing 30 days' written notice. No refund will be issued for the current billing period.
By TweakSpace: We may suspend or terminate your account immediately if you breach these Terms, fail to pay, or engage in conduct that poses a risk to our platform or other clients. We will provide notice where practicable.
Effect of termination: Upon termination, your access to the platform will cease. You may request an export of your data within 30 days of termination, after which it will be deleted in accordance with our retention policy.
These Terms are governed by and construed in accordance with the laws of Kenya. Any disputes arising under these Terms shall first be referred to good-faith negotiation between the parties.
If a dispute cannot be resolved within 30 days of written notice, it shall be referred to arbitration in accordance with the Arbitration Act (Cap. 49, Laws of Kenya), seated in Nairobi.
We may update these Terms at any time. When we make material changes, we will notify you by email at least 14 days before the changes take effect. Your continued use of the platform after that date constitutes acceptance of the updated Terms.
